I. GENERAL PROVISIONS

  • These terms of service (the “Terms of Service”) govern the conditions of access and the rules for using the website at https://terraeye.co/ (the “Website” or “Site”), operated by Remote Sensing Business Solutions sp. z o.o. with its registered office in Wrocław, ul. Długosza 60A, 51-162 Wrocław, entered into the register of entrepreneurs of the National Court Register under KRS number: 0001105923, NIP (Tax ID): 8952241235, REGON: 521932803, with a share capital of PLN 1,553,401.44 (the “Company” or “TerraEye”).

  • These Terms of Service apply to the use of the Website. The rules for using the dedicated TerraEye analytical application (SaaS) are governed by a separate document.

  • The content, pricing plans, package descriptions, technological parameters, and any other information contained on the Website are for informational purposes only and constitute an invitation to treat within the meaning of Article 71 of the Polish Civil Code. Under no circumstances do they constitute a binding commercial offer within the meaning of Article 66 of the Polish Civil Code.

  • Any person using the Website (the “User”), upon entering the Website, is obliged to read, comply with, and accept these Terms of Service. In the event of non-acceptance, the User should cease using the Website and leave it.

  • The Site is intended exclusively for professionals and business entities (B2B). The Company does not direct its services to consumers.

II. RULES FOR USING THE WEBSITE

  • For the proper operation of the Website, the devices used by the User to access the Site must meet the following minimum technical requirements:

    • Internet connection,

    • operating system: Android or iOS, in the most current version,

    • latest versions of web browsers,

    • to fully utilize the Website's functionalities, we recommend enabling JavaScript and accepting cookies in your web browser.

  • TerraEye is not liable for difficulties in using the Website's functionalities resulting from technical limitations and problems related to the equipment used by the User.

  • All data transmission costs required to use the Website shall be borne by the User in each case, based on appropriate agreements concluded with Internet service providers or telecommunications operators.

  • TerraEye reserves the right to interruptions in access to the Site related to maintenance or introducing changes to the Site, removing defects, erroneous or outdated information, upgrades, and changes to the graphic layout of the Site, as well as interruptions resulting from causes beyond the Company's control. We strive to keep interruptions in access to the Site as short as possible.

  • Users commit to using the Website in compliance with generally applicable law, in particular:

    • the Act of 12 July 2024 - Electronic Communications Law (Journal of Laws item 1221, as amended),

    • the Act of 18 July 2002 on providing services by electronic means (consolidated text: Journal of Laws of 2024, item 1513, as amended).

  • Please be advised that the User's use of the Website to conduct activities infringing the rights or interests of the Company is prohibited.

  • It is prohibited to use the Website:

    • in a manner leading to a violation of legal provisions,

    • in an unfair manner, aiming to circumvent the law, or aiming to achieve a state inconsistent with the law or to achieve an unfair goal,

    • in a manner aiming to cause harm to TerraEye or third parties,

    • to transmit or send unsolicited or unauthorized advertisements, promotional materials, or any similar forms,

    • to provide content of an unlawful nature,

    • to send or upload any materials containing malicious software, spyware, adware, or other harmful programs or codes intended to adversely affect or threaten Users.

III. LINKS

  • The Website may contain links directing to other websites, including TerraEye's social media portals. They are provided solely for informational purposes.

  • The Company is not liable for the content found on other sites, nor for any damages resulting from their operation to the extent permitted by law.

  • The User will recognize social media plugins by the icons of these platforms.

  • Social plugins will connect directly to the TerraEye profile on the server of a given portal. The portal may then receive information that the User has visited the website from their IP address.

IV. CONTACT FORM

  • The User may contact the Company, send a request for proposal, or express a desire to book a demo version via dedicated forms available on the Site.

  • When using the forms, the User should read the Privacy Policy and check the required consents or declarations if they wish for their data to be processed for the purposes indicated therein.

  • The costs of a telephone call are borne by the User in accordance with their operator's tariff.

  • The User is obliged to provide only true, current, and professional contact details.

  • It is prohibited to input the personal data of third parties without their consent or other legal basis.

V. INTELLECTUAL PROPERTY

  • All rights to the Website, name, domain, trademarks, as well as the content and photos used on the Website are protected by copyright. Economic copyrights belong exclusively to the Company or third parties with whom the Company cooperates.

  • No materials posted on the Website, nor any part thereof, may be: copied, modified, distributed, published, downloaded, displayed, recorded, compiled, or used in any form and by any electronic, mechanical, photographic, or recording means, without the prior written consent of the Company, otherwise null and void.

  • In particular, it is prohibited to copy, duplicate, distribute, publish, and modify the Website's site, its graphic layout, or source code, as well as the content contained therein.

  • Automated indexing, as well as scraping, in particular through web crawling or web scraping techniques, as well as text and data mining (including for the purpose of training AI) of any content, materials, or data placed on the Website, is prohibited.

VI. LIABILITY

  • To the extent permitted by law, the Site provides no warranties regarding its content, in particular warranties of security, error-free operation, or correct functioning.

  • The Company bears no liability for:

    • links posted on the site, especially if they lead to sites, platforms, and portals operated by third parties,

    • the unavailability of the Site resulting from force majeure or causes attributable to the User.

  • The Company does not provide, beyond the obligations arising from mandatorily applicable legal provisions, any express or implied statutory warranty or guarantee regarding the operation and functioning of the Website, in particular regarding fitness for a particular purpose, customization, security, and reliability of information.

  • The Company informs that despite making every effort to ensure the highest level of security for users, using the Website may involve the risk of infecting the user's device used to access the Site with malicious software - to avoid related threats, it is recommended to install antivirus software and keep it updated.

VII. PERSONAL DATA

  • TerraEye processes related personal data in accordance with applicable personal data protection regulations, in particular with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation).

  • Using the website involves the use of cookies.

  • Detailed information on personal data and its processing can be found in the Privacy Policy available at https://terraeye.co/privacy-policy, which each User should read upon commencing the use of the Website.

VIII. AMENDMENT TO THE TERMS OF SERVICE

  • TerraEye reserves the right to introduce amendments to these Terms of Service. Important reasons authorizing an amendment to the Terms of Service include, in particular:

    • changes in the scope, type, or nature of the services provided by TerraEye or the conditions of their provision,

    • the emergence of new technologies and IT systems affecting the operating principles of the Website,

    • changes in the name of any service covered by these Terms of Service,

    • organizational and technical changes in TerraEye's structure, including in particular transformations, mergers, acquisitions, name changes,

    • technical reasons,

    • force majeure,

    • a change in applicable legal provisions justifying the necessity to change or remove individual provisions of the Terms of Service,

    • disclosure of inaccuracies or non-compliance of the content of these Terms of Service with currently applicable legal provisions,

    • the necessity to adapt the scope of activity to the guidelines, recommendations, decisions, or rulings of a public authority, court, or other entity legally authorized to issue binding orders to it,

    • a final and binding court judgment or administrative decision concerning TerraEye.

  • TerraEye may at any time introduce editorial changes and correct clerical or calculation errors in the Terms of Service that do not affect the rights and obligations of the parties.

  • The User is obliged to read the amended Terms of Service upon receiving such information.

  • TerraEye will inform about the changes on the Website. Changes come into force on the date indicated by TerraEye, not shorter than 7 days from the date of their announcement. Continued use of the Site after this date is equivalent to acceptance of the changes.

IX. COMPLAINTS

  • In the event that any service or performance available within the Site is carried out inconsistently with the Terms of Service, the User may file a complaint.

  • Complaints can be submitted, e.g., electronically to the e-mail address: support@terraeye.co. In the submission, the User should provide: their first and last name, correspondence address, type, and date of occurrence of the reasons for the complaint. If, in order to process the complaint, it is necessary to obtain additional information from the User, the User commits to providing it, under pain of the complaint being rejected.

  • The Company commits to reviewing the complaint within 14 business days, counting from the date of its receipt.

X. FINAL PROVISIONS

  • The Terms of Service are placed continuously on the website https://terraeye.co/website-terms-of-service in a manner that enables users to acquire, reproduce, and record its content.

  • The Terms of Service were created in the Polish language. In the event of linguistic discrepancies, the Polish version shall prevail.

  • The content of the Terms of Service may be saved on a data carrier or printed at any time.

  • A User who is a Consumer may use out-of-court complaint and redress mechanisms. A description and the rules of access to these procedures are available at the offices and on the websites of district (municipal) consumer ombudsmen, social organizations whose statutory tasks include consumer protection, Provincial Inspectorates of the Trade Inspectorate, and at the following internet address of the Office of Competition and Consumer Protection: https://polubowne.uokik.gov.pl/. In particular, if the Seller has not accepted the complaint regarding goods or services, the consumer may use the network of permanent amicable consumer courts at the provincial inspectorates of the Trade Inspectorate.

  • The competent court to resolve disputes related to the use of the Website is the court having jurisdiction over the Company's registered office, and in the case of a User who is a Consumer, the jurisdiction of the court is determined based on the relevant provisions of law.

  • The law applicable to all matters related to the use of the Website under these Terms of Service is Polish law. In matters not regulated in the Terms of Service, the relevant provisions of Polish law shall apply.

  • The contact point designated for direct communication with Member States' authorities, the Commission, the European Board for Digital Services, and Users is the e-mail address: support@terraeye.co. Communication takes place in Polish or English.

  • In case of doubt, it is established that the User is not bound by those provisions of the Terms of Service that violate mandatorily applicable legal provisions.

  • The Terms of Service enter into force on 18.08.2026.
